Terms and Conditions
Last updated
AutoPeaches is not open yet. Accounts, subscriptions and purchases are not available. These Terms apply from launch, in the version shown when you sign up. Joining the waitlist creates no contract and no obligation to buy.
These Terms are the contract between you and us for the AutoPeaches service. Please read them together with the Acceptable Use Policy, the Privacy Policy and the Cookie Policy, which form part of them.
1. Who we are
1.1 AutoPeaches is provided by FROZEN FLAME TECH LTD, a private limited company registered in Cyprus under number HE 499255, registered office Strovolou 77, Strovolos Center, Office 301, 2018 Strovolos, Nicosia, Cyprus ("we", "us").
1.2 Contact: support at [email protected]; complaints about content at [email protected]; legal matters, privacy requests and notices under these Terms at [email protected]. Under the EU Digital Services Act, [email protected] is our point of contact for authorities and [email protected] our point of contact for users; we communicate in English.
1.3 The service is offered at autopeaches.com and its sub-domains (the "Service").
2. Words we use
2.1 Account: your personal login. Workspace: the shared space in which a team creates and runs Peaches; credits, subscriptions and content belong to a Workspace. Owner and Editor: the two roles a member of a Workspace can hold.
2.2 Peach: an AI character created in a Workspace. Output: images, videos, captions, chat replies and other material the Service generates for you. Your Content: everything you or your team upload or enter (reference images, source videos, prompts, texts, settings); Outputs are not Your Content (clause 11).
2.3 Connected Platform: a third-party service you link to a Workspace, today fan subscription platforms, and Instagram where that feature is available. Fan: a person who interacts with a Peach on a Connected Platform.
2.4 Credits: the prepaid units used to pay for actions in the Service. Engine: a named generation option in the Service (for example "Premium" or "Basic").
2.5 Consumer: an individual acting outside their trade, business, craft or profession. Business customer: anyone else.
3. Who may use the Service
3.1 You must be at least 18 years old and legally able to enter into this contract. We do not knowingly accept users under 18 and will close any such account.
3.2 The Service is built for creators, agencies and businesses, and may also be used by individuals as consumers. Where these Terms treat Consumers differently, that is said explicitly. Nothing in these Terms limits rights that the law of your country gives you as a Consumer and that cannot be waived by contract.
3.3 If you accept these Terms for a company or other organisation, you confirm you are authorised to bind it, and "you" includes that organisation.
3.4 You must give accurate information, keep your login details secret, and tell us at [email protected] if you think your Account has been misused. You are responsible for what happens under your Account.
3.5 The Service is not offered where the law or sanctions forbid it. We may restrict access to the Service by country.
4. Workspaces and teams
4.1 A Workspace may have several Owners and Editors. Owners manage members, billing, connected accounts and deletion; Editors work on content and Peaches. Invitations always grant the Editor role; an Owner can promote a member afterwards.
4.2 The Owners of a Workspace are responsible for their team: for who they invite, for what members do in the Workspace, and for making sure every member follows these Terms and the Acceptable Use Policy. A breach by a member counts as a breach by the Workspace.
4.3 A Workspace must always keep at least one Owner. You cannot leave or delete your Account while you are the only Owner of a Workspace that has other members; promote someone first or delete the Workspace.
5. The Service
5.1 AutoPeaches lets you create AI characters (Peaches), generate images and videos of them, train chat assistants that reply to Fans with memory of past conversations, connect Connected Platforms, and schedule, post, reply and sell on those platforms on your instruction.
5.2 Engines, not models. Features are offered through Engines named by us. We use third-party AI technology to run them, we choose and change that technology at our discretion, and we do not disclose which model or provider runs a feature. An Engine's results may change when we change the technology behind it.
5.3 AI output is unpredictable. Outputs are generated automatically and may be inaccurate, inconsistent, or not what you asked for. Similar requests from other customers can produce similar outputs. You must review Outputs before you publish or send them, except where you have deliberately switched on an automation that sends on your behalf (clause 6).
5.4 Outputs are synthetic. Every Output is AI-generated, even when it looks real. We may label or watermark Outputs as AI-generated, visibly or invisibly (for example in the file's metadata). You must not remove, alter or hide such a label or watermark where the law requires AI-generated content to be marked.
5.5 Some features are marked as early or coming soon. They may change or be withdrawn.
5.6 Inspiration content. Looks, Moodboard and similar examples that we provide remain ours. You may use them inside the Service as inspiration for your own Outputs.
5.7 We may refuse a generation request, for example when it breaks the Acceptable Use Policy or a safety filter blocks it.
5.8 We keep developing the Service and may change, add or remove features. If a change removes a core feature you pay for, we will tell you in advance and you may cancel (clause 14).
6. Connected Platforms (fan subscription platforms, Instagram)
6.1 When you connect a Connected Platform, you authorise us to act on that account on your instruction: to read the messages and events it sends us, to send replies, messages, offers and media you have prepared or that an automation you switched on prepares, and to post or schedule content.
6.2 You stay responsible for your accounts on those platforms and for following their terms, community rules and content policies, including any rule on adult content, AI-generated content, AI-assisted chat, disclosure to Fans and payments. We are not a party to your contract with them.
6.3 Automations (for example automatic replies to Fans or follow-ups) run only when you switch them on, and you can pause or take over a conversation at any time. Automations pause while your Workspace has no active subscription.
6.4 We keep a record of every outbound action we take on a Connected Platform (what, when, for which Workspace).
6.5 Connected Platforms can change or restrict their interfaces, suspend accounts, or refuse content. We are not responsible for their decisions or for features that stop working because of them.
6.6 Purchases Fans make on a Connected Platform are between you, the Fan and that platform. Sales figures we show you are for your information.
7. Subscriptions and access
7.1 You need an active subscription to use the app. Without one, the product pages are locked; account, billing, support, team and workspace settings stay available.
7.2 Plans, per Workspace, billed monthly or yearly:
| Plan | Monthly billing | Yearly billing (paid up front) | Credits per month |
|---|---|---|---|
| Basic | USD 20 a month | USD 160 a year | 2,000 |
| Creator | USD 50 a month | USD 400 a year | 5,000 |
| Studio | USD 100 a month | USD 800 a year | 10,000, plus a 5% bonus (500) |
The features and the number of Peaches each plan includes are as shown on the pricing page when you buy.
7.3 Renewal. A subscription renews automatically until cancelled. A monthly subscription renews every month on the same day: we charge the monthly price and grant that month's credits. A yearly subscription is paid for the whole year up front; its credits are granted every month of that year, and it renews every year on the same day, when we charge the yearly price. We email the Owners a reminder 7 days before each yearly renewal.
7.4 Upgrades apply immediately. You pay a prorated charge for the rest of the current billing period (month or year) and receive a matching prorated share of the extra credits for the current month, which expire at the end of that month.
7.5 Downgrades take effect at the end of the current billing period (month or year). You keep your current plan until then.
7.6 Cancellation stops the next renewal. Your plan, including the monthly credits of a yearly plan, continues until the end of the month or year you paid for. You can cancel, and undo a cancellation before it takes effect, from the billing page. There is no refund for the month or year in progress, including unused months of a yearly plan, except where the law requires one (clause 10).
7.7 Failed renewal. If a renewal payment fails, access to the app closes at once and we email the Owners. You have 7 days to update the payment method. If payment succeeds within those 7 days, access reopens and your credits are kept. If it does not, the subscription ends and clause 8.6 applies.
7.8 Only Owners can subscribe, change plan, buy top-ups, change the card or cancel. Editors can see the plan and credits.
8. Credits
8.1 What credits are. Credits are a prepaid, non-transferable right to use the Service. They have no cash value, are not money or e-money, cannot be exchanged for money, and are tied to the Workspace that holds them. 100 credits correspond to USD 1 of purchase price.
8.2 Prices of actions. Each action (a generation, a video, a chat answer and so on) shows its price in credits in the app before you start it. We may change the credit price of actions; changes apply to actions started after the change.
8.3 Monthly allowance. The credits included in your plan are granted every month, on yearly plans too, and are valid until the end of the month they were granted for. Unused allowance does not roll over.
8.4 Top-ups. While subscribed, Owners can buy one-off top-ups:
| Top-up | Price | Credits |
|---|---|---|
| 2,000 credits | USD 20 | 2,000 |
| 5,000 credits | USD 50 | 5,000 |
| 10,000 credits | USD 100 | 10,000 |
Top-up credits are valid for 12 months from purchase, or until your subscription ends, whichever comes first.
8.5 Spend order. Credits that expire first are spent first, so the monthly allowance is used before top-up credits.
8.6 Forfeiture. All remaining credits, top-ups included, are lost without compensation when:
(a) the subscription ends (after cancellation, or 7 days after a failed renewal that was not fixed);
(b) the Workspace is deleted; or
(c) the Account of the last member of a Workspace is deleted.
This applies to Consumers and Business customers alike. We show the credits at stake before you cancel or delete.
8.7 Failed and refused actions. If an action fails for a technical reason, on our side or our provider's, or our provider refuses it, the credits charged for it are returned to your balance. Credits are not returned when an Output is produced but you do not like it. A refusal does not stop us acting under the Acceptable Use Policy.
8.8 Chat answers. Automatic replies to Fans are charged per answer at the price shown in the app, from the same balance, and only after the answer has been produced successfully.
8.9 We may correct a credit balance that is wrong because of a technical error or misuse.
9. Prices, tax, payment and invoices
9.1 Prices are in US dollars. VAT is not included where it applies; it is calculated at checkout from your billing address (and your VAT number, if you give one) and shown before you pay.
9.2 EU business customers with a valid VAT number are invoiced without VAT under the reverse-charge rule. Customers in Cyprus pay Cyprus VAT. Customers outside the EU pay no EU VAT. Any other taxes, duties or bank charges in your country are yours.
9.3 Payments are processed by our payment providers (currently Stripe). We never see or store your full card number. You authorise us, through our payment providers, to charge your payment method for each renewal, upgrade and top-up. The available payment methods are those shown at checkout. Because we take payments through card networks and payment providers, your use of the Service must also comply with their rules (clause 11.5).
9.4 Invoices are issued by FROZEN FLAME TECH LTD for every payment and sent by email to the Workspace Owners; they are also available on the billing page.
9.5 We may change plan or top-up prices. A price change for an existing subscription takes effect from the next renewal after we have given you at least 30 days' notice; you can cancel before it applies.
9.6 If you dispute a payment with your bank (chargeback) without first contacting us, we may suspend the Workspace until the matter is settled.
9.7 Billing descriptor. Our charges appear on your card or bank statement as AUTOPEACHES.COM.
10. Right of withdrawal and refunds
10.1 Consumers in the EU normally have 14 days to withdraw from an online contract. Our Service and its credits are supplied immediately after payment. At checkout you are therefore asked to tick, unticked by default, the following box:
"I understand that the service starts immediately, that I lose the 14-day right of withdrawal, that there are no refunds except where the law requires them, and that unused credits do not roll over and are lost if my subscription ends."
10.2 By ticking it you expressly ask us to start at once and acknowledge that you lose the right of withdrawal once the supply has begun. We confirm this in the purchase confirmation email. You cannot pay without ticking the box.
10.3 If, despite clause 10.2, the law gives you a right to withdraw (for example because the supply had not started), we refund what you paid, less a proportionate amount for the Service supplied and the credits used up to the moment you told us.
10.4 No refunds except where the law requires them. Payments for subscriptions (monthly or yearly), upgrades and top-ups are not refundable, in whole or in part, including for unused credits, a month or year in progress, unused months of a yearly plan, or credits forfeited under clause 8.6. This does not affect refunds the law requires, for example a duplicate charge, a charge we made in error, or a Service we did not provide. Write to [email protected].
10.5 You can always cancel future renewals (clause 7.6).
11. Your Content and Outputs
11.1 Outputs. Outputs are owned by us, to the extent AI-generated material can be owned. We grant you a perpetual, worldwide, royalty-free licence to use, copy, modify, publish, sell and otherwise exploit your Outputs for any lawful purpose, including commercially. This licence survives the end of your subscription and the deletion of your Workspace or Account, except where we end your access because of a breach of section 2 of the Acceptable Use Policy; in that case the licence ends too. We keep the right to store, analyse and use Outputs to operate, secure and improve the Service (including under clause 11.3). Unless we agree otherwise with you in writing, we may also display Outputs, in a form that does not identify you, to promote the Service, for example on our website, in examples and in advertising.
11.2 Your Content stays yours. Material you or your team upload or enter, such as reference images, source videos and prompts, remains yours. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit, display and modify Your Content as needed to provide, secure and support the Service for you, to improve the Service and train our models and systems (clause 11.3), to comply with the law and to enforce these Terms. This includes sending it to our technology providers to perform the actions you request and to Connected Platforms on your instruction. The licence ends when Your Content is deleted from our systems, except for copies we must keep by law and copies that remain in backups until they expire.
11.3 Training and improvement. We may use Your Content and Outputs (prompts, reference material and Outputs) to train and improve our models and systems. We do not use conversations with Fans for training. We do not show Your Content or your Outputs to other customers.
11.4 Real people: consent and age. You confirm you have all rights and consents needed for what you upload and for how you use Outputs, including the consent of any real person whose image, voice or likeness appears in material you upload or in an Output, and that every such person was at least 18 when the material was made (see the Acceptable Use Policy, section 3). On our request you must give us proof of that consent and of that person's age within five business days. If you do not, we may remove the content concerned. AI-generated material may not be protected by copyright in some countries and may resemble existing works; you are responsible for checking before you publish or sell.
11.5 Payment network rules. Whether you are a Consumer or a Business customer, you confirm that Your Content, your Outputs and the way you use them comply with the rules of the card networks and payment providers through which the Service is paid for (card-brand rules), in addition to the law and the Acceptable Use Policy.
11.6 Feedback. If you send us ideas or suggestions, we may use them freely.
12. Acceptable use
12.1 You must follow the Acceptable Use Policy. In short:
(a) no real person's likeness without that person's consent;
(b) nothing involving minors, real or apparent, in any sexual or suggestive context — ever;
(c) adult content only in the Private studio, never on the public lane, and only to destinations whose rules allow it;
(d) follow the rules of every Connected Platform you use;
(e) no illegal content and no attempts to break, overload, reverse-engineer or abuse the Service.
12.2 We may refuse, block or remove content, pause automations, or suspend a Workspace that breaks the Acceptable Use Policy (clause 14).
13. Personal data and Fans
13.1 How we handle personal data is described in the Privacy Policy.
13.2 Fan data. When you connect a Connected Platform, we process personal data of your Fans (their identifiers, handles, messages, purchases and the memory your chat assistant keeps). For this processing you and we are joint controllers. Our arrangement is:
(a) You are responsible for having a lawful basis to connect your account and use the Service with your Fans, for telling your Fans what the platform's rules require (including any required disclosure that replies may be AI-assisted), and for passing on to us, without delay, any request from a Fan about their data that concerns our processing;
(b) We are responsible for the security of the Service, for our technology providers, for the information about this processing in our Privacy Policy, and for answering Fan requests sent to us, involving you where needed;
(c) A Fan may exercise their rights with either of us.
13.3 Team members. You may invite people only if you are entitled to share their email address with us for that purpose.
14. Suspension, termination and deletion
14.1 By you. You can cancel your subscription (clause 7.6), delete a Workspace (Owners) or delete your Account at any time from the settings. Deletion asks you to confirm and to sign in again.
14.2 By us. We may suspend or end your access, in whole or in part, with notice where reasonable:
(a) if you or your team seriously or repeatedly break these Terms or the Acceptable Use Policy;
(b) if payment fails and is not fixed (clause 7.7);
(c) if the law, a court, an authority or a Connected Platform requires it; or
(d) to protect the Service, other users, Fans or third parties from harm.
We will tell you the reason unless the law or safety prevents it. In urgent cases (for example suspected child sexual abuse material or non-consensual imagery) we act first and tell you afterwards.
14.3 We may also end the Service for everyone with at least 60 days' notice; if we do, we refund any prepaid amount for months not yet started.
14.4 What happens on deletion.
(a) A deleted Workspace becomes unreachable for all members at once. Owners can restore it until we purge it; a restore does not reconnect Connected Platforms. Offers already sent on a Connected Platform may remain purchasable there, but purchases made after deletion are not recorded in the Service.
(b) Deleting your Account removes your login and profile at once.
(c) Credits are forfeited (clause 8.6) and any subscription is cancelled.
(d) How long content and records are kept after deletion is set out in the Privacy Policy.
14.5 Clauses that by their nature should survive termination (payment owed, licences needed for retained copies, liability, law and courts) survive it.
15. Availability and support
15.1 We aim to keep the Service available and fast but do not promise uninterrupted availability. Maintenance, provider outages and Connected Platform outages can interrupt it. We do not offer a service-level agreement unless agreed in writing.
15.2 Support is available by email at [email protected] and through the in-app Support page. We aim to reply within 2 business days.
15.3 Keep your own copies of Outputs you need. The Service is not a backup service.
16. Warranties
16.1 We will provide the Service with reasonable skill and care. Apart from that, and to the extent the law allows, the Service and Outputs are provided "as is", without other promises about results, fitness for a particular purpose, sales on Connected Platforms, or that Outputs will be unique or free of third-party rights.
16.2 Consumers keep their statutory rights for digital content and services that do not conform to the contract, including the right to have them brought into conformity and, where the law provides, to a price reduction or to end the contract.
17. Liability
17.1 Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct.
17.2 Subject to clause 17.1, we are not liable for: loss of profit, revenue, sales, Fans, followers or business opportunity; loss caused by a Connected Platform's decision; loss of data you could have avoided by keeping copies; or indirect or consequential loss.
17.3 Subject to clause 17.1, our total liability arising out of or in connection with these Terms in any 12-month period is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
17.4 For Consumers, clauses 17.2 and 17.3 apply only as far as the law of their country permits.
18. Your responsibility towards us (business customers)
18.1 If you are a Business customer, you will compensate us for reasonable losses and costs (including legal fees) arising from claims by third parties — including Fans, people depicted in Your Content, and Connected Platforms — that result from Your Content, your use of Outputs, or your or your team's breach of these Terms or the Acceptable Use Policy.
19. Changes to these Terms
19.1 We may update these Terms, for example for new features, legal changes or prices. For changes that materially affect you we will give at least 30 days' notice by email or in the app. If you do not agree, you can cancel before the change takes effect; continuing to use the Service afterwards means you accept the new Terms.
19.2 Changes needed for legal or security reasons may apply sooner.
19.3 The date at the top shows the version. Earlier versions are available on request.
20. Law, courts and disputes
20.1 These Terms are governed by the laws of the Republic of Cyprus.
20.2 The courts of Cyprus have jurisdiction over disputes arising from these Terms.
20.3 If you are a Consumer living in the EU, you also keep the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in the courts of your country of residence.
20.4 Please contact us first at [email protected] or [email protected]; most problems can be solved quickly. Consumers may also use an out-of-court dispute resolution body. In Cyprus this is the Consumer Protection Service, Ministry of Energy, Commerce and Industry, Andrea Araouzou 6, 1421 Nicosia (hotline 1429, www.consumer.gov.cy); consumers in other EU countries may use the bodies available there.
21. General
21.1 These Terms, with the policies they refer to and the details shown at checkout, are the whole agreement between us about the Service.
21.2 You may not transfer your rights under these Terms without our written consent. We may transfer them to a company that takes over the Service, provided your rights as a Consumer are not reduced.
21.3 If a clause is found invalid, the rest stays in force.
21.4 If we do not enforce a right at once, we have not given it up.
21.5 These Terms are written in English. Translations may be provided for convenience; where the law allows, the English version prevails.
21.6 Notices to us go to [email protected]. Notices to you go to the email address of your Account or are shown in the app.
